Be Proactive! Get Your VA Claim File! WHILE WAITING FOR YOUR DECISION LETTER, SUBMIT YOUR PRIVACY ACT REQUEST FOR YOUR VA C-FILE.

Plan for a VA Screw-up

Assume VA will get something wrong. They NEVER make a mistake and pay too much.

This is not a single battle. You are in a war. FIGHT for your benefits!

Electronic signatures are no longer acceptable, in the 21st century VA now requires a "wet" pen and ink signature.

Email used to be listed on the form at FOIA.vbarmc@va.gov , but the form was modified to take out the email in August 2023.

Fax is still ok, although I would love an explanation how the electrons of a fax signature are different from an emailed form. Maybe the VA has a special fax machine that get wet when received by the VA?

VA is getting a little faster, but still takes months to provide YOUR C-File.

Time your request:

Because of the delay, request your C-File to hopefully get the damn thing with everything in the file soon after you receive your Rating Decision.

  • if you had a C&P exam, wait a month and submit your request; or
  • If you have a complex claim with several disabilities - wait until four months after you filed;  or
  • If you have only one or two disabilities - do it in two months.

If you wait for your Rating Decision, four months starts from your request date.

If you get everything you deserve by some miracle, your file will be complete when you need to apply for an increase.

If you did not get everything because things "crossed in the mail" just do another request after your Decision Letter. It is FREE!

REASON - months to manually review the file for PII - (Personally Identifiable Information)

THEY ARE REVIEWING YOUR INFORMATION IN FILES MAINTAINED BY THE GOVERNMENT ON YOU TO REDACT INFORMATION ABOUT WHO WORKED ON YOUR FILE TO PROTECT THE VA FROM YOU!

IF IT DID NOT BELONG THERE, WHY IS IT THERE IN THE FIRST PLACE?

GOVERNMENT TRANSPARENCY AT ITS FINEST.

Despite the fact that the technology exists to do this job in ONE SECOND!

Hey VA - Use the technology

In the 21st century, they will mail you a CD.

HEY VA - USE THE TECHNOLOGY!

SUBMIT MAIL, FAX OR IN PERSON BY VARO APPOINTMENT

Email used to be listed on the form at FOIA.vbarmc@va.gov , but the form was modified to take out the email in August 2023. This still appears on the VA.GOV web page link below. Just ignore the out of date VA information, they are far too busy to be bothered with making corrections that would be helpful.

Fax is still ok, although I would love an explanation how the electrons of a fax signature are different from an emailed form. Maybe the VA has a special fax machine that get wet when received by the VA?

High tech, works in conjunction with VA CD players maybe?

CONGRESS RECOGNIZED THE PROBLEM....

There is proposed legislation floating around to require response in 30 days.

We shall see....

The technology exists to provide a link or file in 30 seconds, but the VA prefers the human touch (that takes months).
